1. Validity of the AGB

The general terms and conditions are based on Swiss law and apply within Switzerland, provided that the parties expressly or tacitly accept them. Amendments and subsidiary agreements shall only be effective if confirmed in writing by the Supplier. If a contract is concluded and the customer also submits general terms and conditions, the corresponding points apply. A written agreement shall be made with regard to the deviating components. These General Terms and Conditions are valid for an indefinite period of time, as long as they have not been changed by the parties in a written agreement. In all other respects, the provisions of the Swiss Code of Obligations concerning the purchase contract (Art. 184 et seq. OR) as well as other Swiss laws and ordinances shall apply. Should any provision of this contract be or become invalid, or should the contract contain a loophole, the legal validity of the remaining provisions shall remain unaffected. In place of the ineffective provisions, an effective provision shall be deemed to have been agreed from the outset which comes closest in economic terms to the provision intended by the parties. The same applies in the event of a gap.

2. Terms of delivery

2.1 Delivery to Switzerland

The delivery to customers in Switzerland is made against invoice at the prices indicated in the shop in Swiss francs. These include the statutory Swiss value added tax of currently 8.1% and packaging. The shipping costs depend on the weight. The shipping costs calculated in the online shop after entering the place of delivery apply.

2.2 Delivery to Germany and other EU countries

The delivery to customers in Germany and the other EU countries takes place against prepayment. The prices quoted in the online shop include 8.1% Swiss VAT (excl. shipping costs). First the destination of the ordered goods must be indicated. The shipping costs and VAT will then be calculated. Only with the agreement of the buyer to this individual offer the sales contract comes into being.

2.3 Delivery to other countries

The delivery to customers in all other countries takes place against prepayment. Prices indicated in the OnlineShop are incl. 8.1% Swiss value added tax (excl. shipping costs). As a rule, the legal value added tax of the recipient country must be paid upon receipt of the parcel by the customer. Shipping costs are calculated individually depending on the country of destination. The effective total costs (excl. statutory sales tax of the recipient country) are calculated individually after the online order and sent to the interested party by e-mail. Only with the agreement of the buyer to this individual offer the sales contract comes to an end.

2.4 Delivery times

3R AG undertakes to deliver the agreed products to the customer on the specified dates, while the customer undertakes to accept and pay for these products at the specified time. The normal delivery time is 2 to 10 working days. The dates shall be postponed appropriately if obstacles occur which are beyond the control of the supplier, such as natural disasters, accidents, illness, strikes, considerable operational disruptions, war mobilization, delayed or defective deliveries as well as official measures.

3. Fulfilment of contract

The order confirmation is decisive for the scope and execution of the delivery. 3R AG shall deliver the products in the version ordered. Unless a special place of performance has been agreed upon by the parties or results from the nature of the business, the provision of the products at the supplier’s registered office shall be deemed to be delivery. Unless expressly agreed otherwise, benefit and risk shall pass from the sender to the customer upon dispatch of the goods. Unless a special acceptance procedure has been agreed, the customer must inspect the products himself and report any defects immediately in writing. If the customer fails to notify us within one week of delivery, the products shall be deemed to be free of defects in all functions and the delivery shall be deemed to have been approved. The customer is then obliged to pay on time.

4. Warranty

3R AG undertakes to exercise due care and to supply the products in good quality. It also undertakes to carefully select, train and expertly work the employees deployed and to monitor them. The warranty period is two years. In the event of defects in the delivered goods, the customer may demand cancellation or reduction of the purchase price in accordance with the Swiss Code of Obligations or demand goods of the same type as replacement. The provisions of the OR apply. Excluded from the warranty are defects and malfunctions for which the supplier is not responsible, such as natural wear and tear, force majeure, improper handling, interventions by the customer or third parties, excessive strain or extreme environmental influences. If the customer resells the products, he is responsible for compliance with domestic and foreign export regulations. If the customer changes the resold products, the resulting damage is liable to the supplier, the buyer or third parties. The provisions of the Product Liability Act remain reserved.

5. wrong orders

Orders under false names (false names or addresses, credit card numbers of stolen cards) will be prosecuted.

6. final provisions

Place of jurisdiction is Sulgen. However, 3R AG may also call upon the court at the customer’s registered office. The parties shall endeavour to settle any disputes arising from the performance of this Agreement by amicable means.
